The 10th anniversary of the approval, publication and transposition of the 2014 public procurement directives represents an ideal opportunity to assess their impact, shortcomings and unresolved challenges in the procurement field. The directives of the fourth generation of the European Union in this area had ambitious objectives: increasing the efficiency of public spending to ensure the best possible results in terms of quality/price ratio, facilitating the participation of SMEs, among others. In addition, they sought to enable public buyers to use procurement to achieve common social objectives, such as environmental protection, greater energy efficiency, combating climate change, promoting innovation, social integration, and providing high-quality social services in the best possible conditions.
One of the main achievements of the 2014 directives has been the incorporation of strategic public purchasing, allowing social, environmental and innovation objectives to be achieved.
The new contractual regulations have recognized as general principles the need for all Administrations and public entities to comply with social and environmental requirements in line with the United Nations 2030 Agenda and Sustainable Development Goal 12, which promotes sustainable consumption and production patterns. Despite these advances, strategic public procurement is not consolidated and, when contrasted with the data and impact evaluations, important problems are revealed in the application and interpretation of these regulations.
In the proposed webinar, the reference to the standard and the analysis of its application are carried out in order to identify and propose improvements that contribute to society, public administration and the environment. Topics that are addressed with the purpose of promoting public procurement as a legal tool for compliance with public policies for the sustainability of life.
